LEGAL CHALLENGES FACED BY LIBRARIES DURING DIGITAL TRANSFORMATION WHEN IMPLEMENTING THE NEW COPYRIGHT FRAMEWORK UNDER THE AMENDED 2022 INTELLECTUAL PROPERTY LAW

Abstract

Digital transformation is an inevitable trend in the library sector, where knowledge is stored and protected by intellectual property rights (copyright). This poses a significant challenge in building digital data resources for digital transformation. By comparing two systems of texts on copyright with the new provisions of the Intellectual Property Law 2022 and Government Decree 17/2023/ND-CP of April 26, 2023, and the system of texts from the digital transformation library, this article identifies the trend of copyright enforcement in the digital transformation of the library sector and proposes policy-implied solutions for enforcing copyright in the implementation of digital transformation in Vietnamese libraries.
