Instituting civil cases for public interests by the People’s Procuracy of China and recommendations to improve Vietnamese civil procedure law

Abstract

Both Chinese Civil Procedure Law and Vietnamese Civil Procedure Code have provisions of instituting civil cases for public interests. While China highly appreciates role of the People’s Procuracy in initiating civil cases in legal regulations and law enforcement practice as well, there has been no regulation on this function of the People’s Procuracy of Vietnam creating a legal gap that need to be filled. The article analyzes a number of law provisions and law enforcement on the role of the People’s Procuracy of China in initiating civil cases for public interests, then make some proposals to perfect Vietnamese civil procedure law.
