The application of legal precedent in adjudication in Vietnam and a number of proposals for improvement

Abstract

Law on Organization of the People’s Court in 2014 has recognized legal precedent as an official source of law which created a new development in adjudication particularly and the our judiciary generally. In addition to the achieved results, there has been a number of challenges in the application of legal precedent in Vietnam. Therefore, the article clarifies the application of legal precedent in Vietnam, assesses the limitations and inadequacies; thereby makes a number of proposals to complete this matter.
