Abstract

The paper analyzes the quantitative damage factor in determining the constitute of the Crime of illegally manufacturing, storing, transporting, using, trading or appropriating military weapons and technical means specified in Article 304 of the 2015 Penal Code. It also points out difficulties and obstacles in law application in practice, then gives directions and some recommendations to improve the regulation on damage quantification in this Article.
