Exercing prosecution rights and prosecuting in prosecution period of human trafficking cases

Abstract

Like other criminal cases, after Investigation Agency concludes investigations, transfer the dossiers to the Procuracy to propose prosecuting, the Procuracy accepts them, the investigation period shall end. Concurrently, it opens a new proceeding stage called prosecution period. The Procuracy issues, serves the indictment and transfers the dossiers to the Court. It is accepted by the Court then the prosecution period shall end. The Procuracy is the only procedure agency in prosecution period including subjects conducting legal proceedings namely the Prosecutor General, Deputy Prosecutor General, Prosecutor and Prosecutor assistant. However, in human trafficking cases prescribed in Article 150 and trafficking of under 16 years old person cases in Article 151 of the 2015 Penal Code, besides foundamental requirements in prosecuting, subjects conducting legal proceedings need to pay attention to some other features.
