Abstract

Applying the criminal law is an activity that has massive impacts not only on the offenders’ legitimate rights and interests but also on the offenders themselves as well as the society negatively and positively. In a developed society, respecting human rights, ensuring the humanitarianism and inclining to the good in the application of the criminal law are the inevitable trends. This article, therefore, analyzes and clarifies the characteristics of being humanitarian and inclined to the good in the application of Vietnam’s criminal law recently  together with offers a number of recommendations to enhance the humanitarianism and good inclinations in the law application.
