Abstract

Compared with the Penal Code in 1999, this is the first time in the history of our criminal law that the Penal Code of 2015 has stipulated and recognized the criminal liability of a commercial criminal entities by defining the type Legal entities, conditions and scope of criminal liability for legal persons, as well as specific types of crimes that can be punishable by a legal person. On the basis of studying the provisions on criminal liability of criminalized commercial legal persons, the author has pointed out the conditions and scope of criminal liability for commercial criminal offenders. There are a number of considerations in determining criminal liability for a commercial offender.
