Some obstacles and inadequacies in legal proceedings applied in cases of inheriting civil procedural rights and obligations in the Civil Procedure Code of 2015

Abstract

The appearance of a person who inherits civil procedural rights and obligations may take place at different stages of the legal proceedings. At each stage, the agencies conducting the proceedings need to apply different legal procedures which lead to different effects on the civil cases. The author would prefer to present the applicable legal proceedings on the Court when there’s a person inheriting the civil procedural rights and obligations in accordance with the Civil Code of 2015. In addition, we will find out some legal consequences and shortcomings of the proceedings toward the civil cases being settled. At the same time, the article has reference and comparison in the corresponding cases of civil procedure laws from some countries such as the United States, Russia and France.
