DRAFT LAW ON HIGHER EDUCATION - DISCUSSION AND RECOMMENDATIONS

Abstract

To contribute to removing difficulties and shortcomings in terms of institutions and policies after 13 years of implementing the Law on Higher Education No. 08/2012/QH13 and 6 years of implementing the Law on amending and supplementing a number of articles of the Law on Higher Education No. 34/2018/QH14, this article conducts research and analysis of the current Law on Higher Education and the Draft Law on Revised Higher Education to point out the remaining problems and make recommendations to improve the legal system on higher education, contributing to the implementation of the spirit of Resolution No. 71-NQ/TW issued on August 22, 2025 on breakthroughs in education and training development. The article analyses and points out the issues that the Draft Law on Revised Higher Education needs to continue to study and improve, such as issues on the "two-level" university model and the mechanism of controlling power in higher education institutions; The autonomy mechanism and the school council institution aim to contribute to putting the revised Law on Higher Education into practice in university governance and effective organisation of training activities.
