The settlement of land disputes for ethnic minority people in Van Canh district, Binh Dinh province

Abstract

Studying the current situation of resolving land disputes related to the Cham and Bana ethnic minorities at Van Canh District People's Committee and District People's Court is one of the key bases supporting the agencies to propose efficient solutions in settlement of land disputes. Using questionnaire method and data collection, the study shows that land disputes involving ethnic minorities in Van Canh district account for more than 70,8% of local land disputes. The main dispute types are: disputes over land use rights; property disputes on "Ca Than" forest land between Cham and Bana, land disputes among Cham, Bana and Kinh; and land dispute between the community and forestry companies. It is noted that while the effectiveness of the land dispute conciliation at the Department of Natural Resources and Environment is 0%, the efficiency of land dispute conciliation at the district people's court reaches 28,8%.
