SETTLEMENT OF EAST SEA DISPUTES BETWEEN VIETNAM AND CHINA UNDER THE UNITED NATIONS CONVENTION ON SEA LAW 1982

Abstract

In recent years, the disputes in the East Sea between Vietnam and China have become more and more serious, the negotiations and negotiations have no longer been effective, with that practice, the article aims to find a compulsory mechanism for resolving disputes in the South China Sea, which is the arbitral tribunal under Annex VII of the UN Convention on the Law of the Sea. The dispute settlement mechanism between Vietnam and China is analyzed based on the provisions of the United Nations Convention on the Law of the Sea, and at the same time, summarizes practical reviews as well as international law to make the thesis, solutions. From the results of the practical assessment of the dispute as well as the analysis of the dispute settlement mechanism in accordance with Annex VII of the Convention, the article will propose a few situations for Vietnam to sue China. The research will help Vietnam have more bases and arguments to resolve disputes in the East Sea with China, which is increasingly tense.
