Abstract

The international law and Vietnamese law respect and protect the right to personal privacy as a basic human right. The application of special methods of investigation and proceedings in criminal procedure is a limitation on the right to privacy in order to balance the right to individuals and the interest of community. However, the current provisions of such methods contain several deficiencies violating the right to privacy of individuals. The paper, firstly, presents the right to privacy and its relation to the special methods of investigation and proceedings, then analyses the deficiencies of such methods and proposes several recommendations.
