LEGAL PLURALISM AND DERIVATIVE CONFLICTS IN LAND ACQUISITION IN MINORITY ETHNIC COMMUNITIES IN BINH PHUOC PROVINCE

Abstract

Conflict of interests over land is an inevitable problem for an economy in transition like Vietnam. A legal pluralism conflict is a clash between customary and indigenous land rights which are granted chronological by different political and economic institutions. The paper presents the types and causes of land conflicts due to the acquisition and allocation of forestry and agricultural land in ethnic minority areas, in which disputes and lawsuits related to land use rights conflicts arise. Taking a diversity approach based on the socioeconomic characteristics of ethnic minorities, identifying barriers to land access as well as the limited ability to socialize in local ethnic minorities results in poverty and socioeconomic backwardness in comparison to other ethnic minorities. At the same time, the allocation of land after acquisition in the enforcement of the local government according to policies to support ethnic minoritieshas had led to land conflicts that make social unrest worse and break up communities.
