AN ANALYSIS OF "CRIMINAL GROUP" UNDER THE REGULATIONS OF THE CONVENTION AGAINT TRANSNATIONAL ORGANIZED CRIME AND EXPERIENCES FOR THE LEGISLATION OF CRIMINAL LAW OF VIETNAM

Abstract

The term "criminal group" and the act of establishing and joining a criminal group for the first time are recorded in Clause 1, Article 14 of the Vietnamese Criminal Code 2017, amended and supplemented in 2017 (hereinafter referred to as the Criminal Code 2015). This is one of the advances of the Criminal Code 2015 to internalize the relevant provisions of the international treaties to which our country is a party, namely the internalization of the provisions of the Convention against Transnational Organized Crime (hereinafter referred to as CTOC). Based on the analysis of regulations on criminal group in CTOC, this article will provide some recommendations to continue to improve the Criminal Code 2015 in the future.
