Some legal issues about recovery of damage to business reputation under CISG 1980

Abstract

Recoverability of reputational damages due to breach of contract under the regime of the UN Convention on Contracts for the International Sales of Goods 1980 (CISG 1980) is one controversial question today. This may lead a threat to uniform application of the CISG and thus might undermine the accomplishment of goals set in Article 7 of the CISG.

Under this paper, the author will introduce the legal issues relating to recoverability of reputational damages, particularly the recognition of the right to claim reputational damages and the issues imposed on the aggrieved party in pratice. Basing on that, it makes recommendations for the aggrieved party in order to resolve the above issues.
