Abstract
Abstract: Framework laws are an objective and widely observed phenomenon in
legal systems, and most countries’ legal systems recognise some form of framework
legislation. The enactment of framework laws is motivated, in part, by the aim of
enabling parliaments/national assemblies to avoid deliberating matters that are overly
detailed or highly technical; more importantly, framework laws help to reduce
legislative burdens in the law-making process. Politburo Resolution No 66-NQ/TW
emphasises the development of framework laws and the delegation of legislative
authority to administrative bodies to specify details through implementing instruments,
thereby ensuring flexibility and responsiveness to the frequent changes of social
relations. This article surveys the practice of enacting framework laws in selected
countries, examines the consequences that may arise, and draws lessons for Viet Nam.
