Abstract

Abstract: Adopting an adaptive regulation approach, this article identifies four
core components of the legal framework for supporting innovative start-ups:
enterprise law, investment law, financial regulation, technology sandboxes, and the
protection of digital intellectual property. Drawing on comparative analysis with
international practice, the article identifies existing legal gaps, including the absence
of a dedicated sectoral law, the lack of cross-sectoral sandbox arrangements, and the
absence of a personal data protection law. It then recommends a roadmap for
improving the regulatory environment for innovative start-ups in Viet Nam through an
open, flexible, risk-based approach that balances the promotion of innovation with the
protection of the public interest in the digital economy era.
