COVID-19 VACCINE: PATENT AND PUBLIC BENEFITS

Abstract

Covid-19 vaccine has been researched, developed and widely applied around the world. This is the result of the creative labor process of subjects in the field of pharmaceutical research. Intellectual property law protects industrial property rights for Covid-19 vaccine in the form of patent, allowing the owner to exploit for a certain period of time. However, in order to protect the public benefits, especially the right to access pharmaceuticals, the legal provisions on the protection of Covid-19 vaccine have their own characteristics. Since then, people especially developing countries have better opportunities to access this product. The article analyzes the ability to protect the Covid-19 vaccine in accordance with the provisions of intellectual property law and the limits of protection to protect the public interest.
