Tóm tắt: Ở Việt Nam, pháp luật về công tác xã hội (CTXH) có 2 dạng, một là pháp luật gián tiếp điều chỉnh hoạt động CTXH, hai là pháp luật trực tiếp điều chỉnh hoạt động CTXH. Để tạo thuận lợi cho nghề CTXH phát triển đáp ứng nhu cầu cung cấp dịch vụ cho người dân cần thiết phải hoàn thiện pháp luật về CTXH dựa trên cơ sở lý luận và bằng chứng thực tiễn. Cơ sở lý luận bao gồm: vai trò của pháp luật đối với phát triển nghề CTXH, vai trò của nghề CTXH đối với người dân, nhu cầu của người dân đối với dịch vụ CTXH; các yếu tố tác động tới quá trình hoàn thiện pháp luật về CTXH.  Cơ sở thực tiễn bao gồm: kinh nghiệm quốc tế xây dựng pháp luật về CTXH; thực trạng pháp luật về CTXH ở nước ta, ưu điểm, hạn chế, khoảng trống và những vấn đề cần phát triển hoàn thiện pháp luật về CTXH. Từ đó đưa ra một số khuyến nghị nhằm hoàn thiện pháp luật về CTXH ở nước ta mà trọng tâm là Luật chuyên ngành về CTXH.

Abstract: In Vietnam, there are two types of social work legislation, the one that indirectly regulates and the other directly regulates social work activities. In order to facilitate the development of social work to meet the needs of providing services to people, it is necessary to improve social work legislation, based on theoretical background and practical evidence. Theoretical background includes: the role of legislation for social work development, the role of social work for people, the needs of people for social work; factors influencing the process of improving social work legislation. Practical evidence includes: international experience in development of social work legislation; the legal status of social work in Vietnam, advantages, limitations, gaps and issues that need to be developed to improve social work legislation. This paper provides recommendations on the improvement of social work in Vietnam, with focus on specialized laws and policies on social work
