Perfecting provisions relating to the suspension of investigation of criminal cases to guarantee the application of the principle of innocence presumption

Abstract

The article studies the principle of presumption of innocence and the implementation of this principle under the 2015 Criminal Procedure Code on suspension of investigation of criminal cases with the aim of assessing the degree of completeness, consistency, and synchronisation between the principle of presumption of innocence and these provisions. From there, the article proposes measures to improve these provisions on suspension of investigation during the investigation period, and suspension of criminal cases during the prosecution stage and the first-instance trial stage of criminal cases under the current Criminal Procedure Code to protect the legitimate rights and interests of the accused.
