Improving legal provisions on rights and obligations of entities involving foreign elements using land in Vietnam

Abstract

In order to implement the Resolution No.18/NQ-TW dated 16/6/2022 of the Central Committee of the Party term XIII on “continuation of renovation, completion of institutions, policies, enhancing of capability, effectiveness on management and use of land, making encouragement to bring our country to become a developed one with high income”, the policy to amend the Land Law is essential. Amongst the basic amendments of this law, not only the completion of rights and obligations of domestic land users but also rights and obligations of entities involving foreign elements making investment and business in commercial houses or purchasing, owning houses in Vietnam is a requirement for the development of the real estate market as well as the process of industrialization and international integration. This article focuses on the amendments in the draft of the Land Law in comparison with the current Land Law to partly complete the rights and obligations in land use of entities involving foreign elements.
