Issues that need to be amended and supplemented in the Vietnam's Law on Marriage and Family 2014

Abstract

The Law on Marriage and Family 2014 has taken effect for more than 07 years. The process of implementing and applying the Law has achieved many results in the construction and development of the socialist marriage and family system in our country. However, the development of economic and social conditions in the new period and provisions of the legal system, especially the civil law, have had many influences on marriage and family relations. In addition, some provisions of the Law on Marriage and Family 2014 are not clear and there is a lack of guiding documents from competent state agencies. Therefore, there are different views on the implementation and application of the 2014 Law on Marriage and Family, which have affected the legitimate rights and interests of the envolved parties. Since then, it is required to amend and supplement a number of provisions of the Law on Marriage and Family 2014 in order to ensure the effectiveness in regulating marriage an family relations, response to the construction and improvement of the current socialist Vietnamese rule of law state.
