Force majeure clauses and their practical uses in sales contracts of condotel

Abstract

It appears that sellers in dealing with sale contracts of condotel dominate and actively expand the force majeure clause in practice. Exceptionally, there are several anticipated legitimate hindrances put into the draft agreements by the seller. Hence, aside from notices to buyers, the paper also analyzes and supplies some recommendations for the official legal recognition of force majeure clauses to release contracting parties’ civil liability for failing to perform obligations properly. The law should clarify the force majeure clauses in implementing the legal documents mentioned in the contract. It also regards the suggestion for accepting or even denying the condotel in Vietnamese laws.
