Insurance liability exclusion clause in the insurance contract in Vietnam and some recommendations

Abstract

The insurance liability exclusion clause is a mandatory provision in the insurance contract under the insurance law of Vietnam. The liability exclusion clause provides for cases where the insurer is excluded from paying for loss or damages after the occurrence of the insured event. The article analyzes the need of designing an insurance exclusion clause in an insurance contract and reviews the current legal framework upon insurance liability exclusion cases based on compared with the contract conclusion practice and the popular regulations in the insurance market. Given such analysis, the article proposes recommendations to improve the current insurance law on the liability exclusion clause.
