Expert witness in international arbitration and some recomendations for Viet Nam

Abstract

On the basis of analyzing expert witness in international arbitration, it is argued that expert witness plays an important part as the provider of professional opinion necessary for fair decisions in arbitration and court proceedings. As a result, harmonizing international regulations and guidelines in the taking and administration of expert witnesses in international arbitration procedures is a critical task not only for arbitration institutes, but also for nations in the context of globalization. This article discusses an overview of expert witnessing in international arbitration, especially the use of expert witnesses in the international construction sector - an area that requires a lot of expertise on complex technical issues, then proposes some solutions to promote the use of expert witnesses in Vietnam.
