Juvenile diversion - Australia's experience for improving Vietnamese law

Abstract

Diversion is measures to deal with juvenile offenders without the application of criminal proceedings. These measure helps juvenile offenders avoid the negative effects of formal criminal proceedings while remaining accountable for the offence. Australian states are applying these measures commonly to juveniles who commit less serious crimes and bring many positive effects such as reducing recidivism, saving costs for legal proceedings and effectively deal with juvenile crime. Vietnam also has measures to help juveniles avoid criminal liability; but they do not completely divert juveniles from the criminal proceedings and are currently not preferred. Australia's experience in dealing with juvenile delinquency has been very helpful in overcoming this situation.
