Abstract

Feminist jurisprudence is a relatively new discipline that evolved from the women's emancipation movement in the late 1960s and 1970s. At that time, more women were began to participate in law studies and professions. They had an idea of ​​using the law to eliminate the unfair and unequal treatment of women at that time. Many questions have been raised, for example, why women are being treated unfairly, why this injustice is not known to so many authorities, and what needs to be done to change such a situation. These questions have become the subject of feminist legal theory. So, what is feminist legal theory? Could a legal theory formulated more than 50 years ago in such a different political and social context can be useful in studying and applying the law in the context of Vietnam? This article concludes that studying the feminist legal theory will benefit the making and implementation of the law in Vietnam nowadays.
