Stages of committing crimes: The theory and application of the 2015 Penal Code and orientations for further legal refinement
Abstract
Criminal law science uniformly divides the process of committing a crime into three stages: Preparing to commit a crime, committing an unsatisfactory crime and committing a completed crime. The 2015 Penal Code, revised in 2017, introduces many new points related to the stages of committing crime. Therefore, on the basis of theoretical research, this article evaluates the current situation of provisions of the current Penal Code on the stages of crime, thereby pointing out the existence, limitations and obstacles as a basis for further improvement of legislation (such as the division of unsatisfactory crimes, the regulation of completed crimes and this problem for commercial legal entities committing crimes), thereby, contributing to the effective and fair handling of criminal liability, as well as the fight against crime.
