Some inadequacies in legislative technique from practical examples in Vietnam

Abstract

Legislative activities and regulatory activities in Vietnam have achieved encouraging results. Many legislative documents have been promulgated, promptly adjusting problems arising from practice. However, there are still many shortcomings in technical issues and legislative thinking which have caused some problems when applying these documents. This paper analyzes and comments on controversial issues, such as technical problems and principles of the prohibition and permission list; the differences between amended legislative documents and replaced legislative documents; the effective date of legislative documents promulgated under simplified procedures in specific cases. Thereby, the paper gives some recommendations to improve the current legislative and regulatory work.
