The nature of land use rights in Vietnam and its impacts on the structure of the Law on land

Abstract

The article presents an overview of the nature of land use rights, the concept of some countries with a developed market economy on the regulation of land-based rights such as England, the United States, France and Germany. The article also points out the structural status of the Law on Land regarding land use rights and other land-based interests in Vietnam. To contribute to the refinement of the structure of the Law on Land in a socialist-oriented market economy, the article has made several recommendations to improve the regulations on land use rights. It also suggests the expansion of rights and land-based interests of land users, as well as suggesting changes in the structure of the Law on Land on the basis of giving more importance to the rights of land users.
