Returning securities as evidence in criminal cases to credit organizations under Vietnamese laws

Abstract

The article evaluates the shortcomings in the enforcement of the priority rights of returning securities as evidence in criminal cases to credit organizations under Vietnamese laws and in practice. From that background, it proposes that credit organizations shall be empowered to handle securities in financial transactions to clear bad debts if it is possible to prove that such transactions have been validly concluded, instead of waiting for the results of criminal cases.
