Regulations on tourism real estate business conditions

Abstract

Tourism real estate in general and tourism real estate business conditions in particular are issues that have not been clarified from a legal perspective. The current principles and conditions for tourism real estate business are mainly implemented in accordance with the provisions of the Law on Real Estate Business on the principles and conditions for business of construction works on common commercial and service land. Meanwhile, in terms of nature, compared to common real estate on commercial and service land, tourism real estate has specific characteristics. Accordingly, to protect the legitimate rights and interests of all subjects participating in legal relations related to tourism real estate business, there should be separated and specialized regulations regarding business conditions for this type of business. The article analyzes the nature and specificity of legal relations related to tourism real estate to point out the need for separate recognition/regulations on tourism real estate business conditions. On that basis, the article comments, evaluates the current law and proposes solutions to improve the regulations on tourism real estate business conditions.
