Regulation scope of competition law: The law of Vietnam and international experience

Abstract

Creating and maintaining a healthy and equal competitive environment among businesses in the market, improving economic efficiency, social welfare and protecting consumers' interests are among the most important goals of the Competition Law. To achievethe the goals, the Competition Law must control anti-competitive, potentially risky and harmful acts to the market no matter where such acts are performed. The article clarifies the regulation scope of the Competition Law of Vietnam; refering to international regulations on this issue as well as commenting on the feasibility of the legal provision on expanding the regulation scope of  Vietnam's Competition Law. Thereby, the article affirms that the application of competition law outside the country territory to protect domestic competition is relatively common in the current competition law; it also emphasizes the need to create a legal framework, resources, determination, professionalism as well as relationships and support between competition authorities to realize this legal provision.
