Organization of employees in the enterprise under the Labor Code 2019 – Some inadequacies and recommendations

Abstract

To improve the labor legal system which meets social-economic developments as well as the international integration nowadays, besides internal trade unions, the Vietnamese Labor Code 2019 added regulations on worker organizations at business enterprises. It was a new and progressive rule that ensures workers' freedom of association in establishing, entering and participating in representative groups apart from trade unions to protect their legitimate rights and benefits. However, until now, this regulation has not been implemented for many reasons. Based on the analysis and determination of inadequacies in the provisions of the law as well as difficulties in the implementation, the article proposes some recommendations to improve the provisions of the Labor Code and the Trade Union Law, to ensure that the organization of employees in the enterprise is established and operated as intended.
