Improvement in law on personal data protection – The perspective from EU experience

Abstract

Personal data plays an increasingly important role and it is considered a fundamental element of e-commerce, e-government, e-court, e-health, etc. Over the last few years, along with the development of science and technology, countries around the world, including Vietnam, have exploited various merits of personal data. At the same time, we have also witnessed many cases of personal data leakage with catastrophic consequences. Stemming from these practices, the article analyzes the general contents of Vietnam's regulations relating to the use and protection of personal data: clarifying the necessity of law improvement, reviewing in-effect regulations on the use and protection of personal data in Vietnam and proposes the structure and content of the decree on the use and protection of personal data. On the basis of analyzing the achievements of the European Union in the regulations on the use and protection of personal data, the article draws conclusions and valuable experiences for reference for the improvement of Civil law in general and personal data laws in Vietnam in particular.
