Ensuring the balance between the State’s and citizens’ interests in the process of identifying land price for calculating compensation

Abstract

Balancing interests in society is the top task of every state because this is the driving force behind the birth of the state. Specifically, when the primitive communal society lost its balance of interests due to the rise of private ownership, the state was born in order to re-estabish this balance of interests. Currently, compensation when the State recovers land is one of the most concerning issues of Vietnamese society. This article analyzes the nature of ensuring the balance between the State’s and citizens’ interests in the process of identifying land price for calculating compensation, thereby, analyzes the compliance of this from three aspects including subjects, methods, and appraisal of the valuation process. On that basis, the authors give suggestions aiming to improve legal provisions related to this issue.
