The practice of implementing the principle of restricting human rights and citizens' rights under the 2013 Constitution

Abstract

International human rights law recognizes that few rights are absolute and reasonable limits may be placed on most rights and freedom. The 2013 Constitution of Vietnam recognized the general principle of restriction of human and citizens’ rights. This can be considered as one of the new progressive provisions. However, the practice of implementing this principle shows some shortcomings. Based on the assessment of the implementation, the article recommends an official interpretation for this principle.
