WTO rules on safeguards and the issues for Vietnam

Abstract

Along with the trend of economic integration, the impact of tariff reductions can be "nullified" by trade remedies, including safeguard measures. In addition, recently, there is also a tendency for countries to increase the use of trade protection tools, hence safeguard measures have also been increased. Therefore, it is very necessary to carry a research on safeguard measures and the tool’s application in the world as well as in Vietnam. The article analyzes WTO provisions on safeguards, the use of safeguards measures in the world and in Vietnam, safeguards investigations against exports of Vietnam, in addition, it is possible to analyze a number of issues posed to Vietnam in the process of enforcing the law on safeguard (litigation), to handle safeguard cases with Vietnamese exports (defense) and propose recommendations to government agencies as well as domestic manufacturers to take advantage of this measure to protect their legitimate rights and interests, and foresee the possibility of investigation of safeguard measures against exports.
