Time limit in arbitration – International experience for Vietnam

Abstract

The Vietnam commercial arbitration law has provisions on time limit for lawsuits, however a number of related issues have not been clarified such as: the role of arbitrator when neither party requests the application of time limit; the effect of the time of pre-procedural conciliation on the time limit for lawsuits as well as the applicability of the these provisions under the Civil Code 2015; the ability of the court to review the dispute on time limit. The article analyzes the incomplete points and suggests solutions to arbitration development in Vietnam in the context of international economic integration.
