New provisions on rights of prisoners of the 2019 Law on execution of criminal judgments and some recommendations
Abstract
Institutionalizing the 2013 Constitution on human rights and citizenship, the Law on Execution of Criminal Judgments 2019 (taken into effect from January 1, 2020) has added rights and obligations of offenders under Article 27. These provisions, which are suitable to the socio-economic development of the country, not only ensure the feasibility of the Law, but also ensure the educational purpose of the penalty. This is one of the important new points in the Law on Execution of Criminal Judgments in 2019. However, the provisions need amendments, supplements and specific guidelines to ensure that offenders will fully exercise all of their legitimate rights and interests. In this article, the author focuses on analyzing the new rights in Clause 1 of Article 27, and at the same time, compares this regulation with international standards, thereby making recommendations for improvement and better right assurance in Vietnam.
