Provisions on community reintegration the 2019 Law of execution of criminal judgments and some proposals for improvement

Abstract

Regulations on community reintegration are the legal basis for implementing community reintegration activities for those who have completed their imprisonment sentences. The Law on Execution of Criminal Judgments 2019 and Decree No. 49/2020/ND-CP dated 17 April, 2020 detailed the implementation of the Law on Execution of Criminal Judgments on community reintegration that its regulations are specific and comprehensive. However, on the basis of clarifying the concept and the meaning of reintgration, the article analyzes the provisions of the Law on Execution of Judgments 2019 on community reintegration. It also proposes some measures to improve the effectiveness of these regulations, icluding: increasing the number of times and the amount of time the offenders’ family reunion; erasing the measure of reducing the number of visits to offenders who violate the discipline; stipulating the functions of the prisons in orienting general occupations; clearly stipulating the minimum amount of money that an offence who has completed his prison sentence, taking into account the cost of transportation and accommodation in a certain period.
