Provisions on execution of criminal judgments against commercial legal entities commiting a crime

Abstract

Under Criminal Code 2015, for the first time, legal commercial entities may be considered as the subjects of crimes, which led to a new Chapter in the Law on Enforcement of crimicnal Judgments 2019: Chapter XI: “Enforcement of criminal judgments of guilty legal commercial entities”, including 10 provisions (From Article.158 to 167). The paper analyzes issues relating to the enforcement of criminal judgments of guilty legal commercial entities, proposes some comments and assessments on provisions in the Law on Enforcement of crimicnal Judgments in 2019 from several aspects: principles, subjects, authority, procedures and legal consequences to guilty legal commercial entities. Fromt these assessments, the paper recommends some solutions from the approach of policy making.
