New provisions on application of judicial measures of the 2019 Law on execution of criminal judgments and some recommendations

Abstract

Judicial measures have contributed effectively to criminal offenders’ responsibility. The implementation of these measures in Vietnam has been specified in the Law on Execution of Criminal Judgments in 2010, created a consistency in the application of such measures to applied agencies. However, the practical application reveals shortcomings and difficulties that need to be settled in order for the better implementation of judicial measures. The Law on Execution of Criminal Judgments in 2019 amended some provisions on the application of these judicial measures. The paper analyses the application of law and new points of the judicial measures including mandatory disease treatment and education in correctional institutions under the 2019 version in comparision with those under the 2010; then provides suggestions for reforming current legal documents concerning mandatory disease treatment and education in correctional institutions.
