Controlling standard form contracts under the Law¬ on Consumer protection of Vietnam

Abstract

Standard form contracts emerged from the industrial revolution in the nineteenth century along with mass production and supply of goods. Around the world, from the 1930s to the 1980s, all member countries of the EC were convinced of the necessity of specific legislation on general terms in consumer contracts. In Vietnam, the fact that enterprises are using standard form contracts to unilaterally impose their will on consumers in the 2000s set the demand and was the foundation for the provisions on controlling standard form contracts under the Law on Consumer Protection of Vietnam 2010. Based on these provisions, the paper analyses the concept of standard form contracts, the need of controlling standard form contracts by law on consumer protection in Vietnam, assesses some results achieved as well as the problems in practice and proposes some recommendations to improve the situation.
