The Hamornization of laws on prevention of high-tech crimes

Abstract

Deriving from national sovereignty, the jurisdiction to crimes in general and high-tech crimes in particular belongs firstly to the state involved in the offense. At the same time, also derived from national sovereignty, the determination of which acts are crimes and the penalties corresponding to those acts are under the exclusive jurisdiction of the state. However, the huge difference among legal systems of countries can hinder the process of crime prevention, including high-tech crimes. The article analyzes the provisions in international legal instruments on cybercrime and the harmonization of laws - a measure which shows respect to national sovereignty but at the same time, limits the large gap between laws of different nations, facilitating international cooperation among countries in crime prevention and punishment. Thereby, the article evaluates the practical implementation of legal harmonization in the prevention of high-tech crimes in Vietnam.
