The right to counterclaim of defendants in first-instance trial preparation under the 2015 Civil Procedure Code

Abstract

This article discusses different points of view on counterclaims, as well as analyzes and reviews the provisions of the Civil Procedure Code 2015 on counterclaims and other related issues in exercising this defendants’ right in civil procedures. Thereby it offers some recommendations for improving the legal provisions on the definition and contents of counterclaims; the conditions and time for defendants to file counterclaims; the settlement of legal consequences in case  where the defendant, who files counterclaims, is summoned to attend the mediation session at  court but fails to appear.
