Exit suspension in criminal proceedings in Vietnam

Abstract

Research findings show that along with advantages, Vietnamese criminal procedure law governing exit suspension still reveals a number of shortcomings such as unclear provisions on whether or not exit suspension can be applied together with another preventive measure; the application of exit suspension when extending the time limit of, or suspending the settlement of information on criminal; the unreasonable restriction of jurisdiction of procedure-conducting bodies to apply this preventive measure; some provisions in the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam 2014 (amended in 2019) is incompatible with the Criminal Procedure Code 2015. This paper analyses issues relating to the measure of exit suspension in criminal proceedings including general awareness and legal provisions, and thereby recommendations are made for legal reform.
