Reviewing the law on persons with disabilities in comparison with the Convention on the rights of persons with disabilities and recommendations for Vietnam

Abstract

The Law on persons with disabilities was enacted in 2010, and after 10 years of implementation, the fundamental rights of the persons with disabilities (PWDs) have been protected by the law. However, PWDs still face difficulties, barriers and challenges in exercising the rights to study, healthcare, employment and vocational training. Vietnam has ratified the Convention on the Rights of Persons with Disablities (CRPD) and ensuring the full participation of PWDs in society is a key obligation of the member states of the Convention. Through analyzing the above- mentioned barriers and challenges, and legal gaps of the law of Vietnam in comparison with the CRPD, the paper proposes some recommendations to improve the law of Vietnam in this regard.
