Compatibility of the law of Vietnam with labour commitments of the CPTPP

Abstract

The Comprehensve and Progressive Agreement for Trans-Pacific Partnership (CPTPP) is the first new-generation of free trade agreement that Vietnam negotiated and it officially came into force. The Argrement includes many non-trade commitments such as the ones on labour or those on environment. The labour commitments require member states to respect, recognise and implement the fundamental international labour standards to establish an equivalent industrial relations framework, which narrows the gap among member states. The paper indicates the compatibility of the current labour law of Vietnam with the CPTPP commitments and thereby offers recommendations towards the compliance with commitments, avoiding violations that lead to complaints or other unexpected legal consequences.
