State-owned enterprises under the CPTPP and challenges for Vietnam

Abstract

Chapter 17 of the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP) on state-owned enterprises includes some new provisions that go beyond the traditional international legal framework governing the operation of this group of enterprises. Although it is advantageous to implement those provisions thanks to the exceptions and the compatibility of the legal system of Vietnam with the majority of interational commitments, Vietnam still faces some challenges. The paper analyses the new provisions of the CPTPP on state-owned enterprises, and focuses on clarifying the challenges for Vietnam in the three main perspectives: the compatibility of the law of Vietnam with the CPTPP; the approach to implementing the CPTPP; and the practice of implementing some obligations of Vietnam.
